What Are the Elements of an Estate Plan?

Estate planning can include many different documents to account for all of your needs, the needs of your beneficiaries, and other wishes you have. They are incredibly customizable to your specific goals, and when you hire an estate planning lawyer, they can help you assess what documents are most useful for your immediate and long-term needs. Some potential documents in your estate plan may include:

  • Last will and testament. A will is a cornerstone of estate planning. It can list the assets within your estate, which includes any financial accounts or personal property you own. The will also states who you wish to benefit from your assets after you die, and names the executor of your estate during probate. Without a will, your assets will be distributed based on the intestate inheritance laws in Florida, and the court will appoint a representative for your estate. If you have minor children, a will enables you to name a preferred guardian. Your will goes through probate court and must be legally enforceable to be effective.
  • Your estate plan can have a trust or multiple trusts, which are legal entities that hold assets and are managed by a trustee. For some types of trusts, you are the trustee during your lifetime, and the successor trustee becomes trustee upon your death. In other trust arrangements, you name another individual as the trustee. Because a trust is a legal entity, it does not go through probate court. The trustee can distribute assets to your named beneficiaries the way you instructed, much more privately than through probate court. This limits the financial losses of the probate process and gives you more control over how funds are distributed and what they are used for.
  • Powers of attorney. Power of attorney documents put an individual in charge of your affairs, such as financial or legal decisions. You can place a healthcare surrogate in charge of medical decisions. A durable power of attorney is used to give those powers to someone when you cannot make them yourself. Disabled people make up 21.1% of the population in Brooksville, compared to 13.7% statewide. While no one expects to be disabled by an injury or illness, it can happen to anyone, and it is more likely to occur as you grow older. By creating power of attorney documents, you can place someone in charge of your affairs in the event that you are incapacitated.
  • Lady Bird deeds. This document allows a property owner to automatically transfer their property to a beneficiary on their death, rather than requiring the property to go through probate.
  • Living will. A living will includes medical directives that state your wishes for medical care. If you are unable to state your wishes, this document can be used to make decisions like end-of-life care, pain management, or respecting spiritual wishes.
